Information and Request for Consent for Personal Data Processing under Article 6.1A of Regulation (EU) 2016/679

In compliance with the obligations set forth by Regulation (EU) 2016/679 regarding personal data processing, effective as of May 25, 2018, we hereby inform you that the company Yachts France, located at Port de Plaisance – 06310 Beaulieu sur Mer (France) (hereinafter referred to as the “Company”), will process your personal data that has been or will be provided to us by you or others. The processing of personal data will be conducted in accordance with existing regulations and under the following conditions.

1. Purpose of Processing

The processing of personal data is exclusively aimed at achieving the following purposes:

a) For preliminary requirements to sales contract formation, execution of the same, and protection of creditor positions arising therefrom;
b) To fulfill any type of obligation required by current laws or regulations, particularly in fiscal matters;
c) For operational, management, and accounting needs;
d) For recording access to the Company’s website and the use of services provided by the site;
e) For monitoring customer relations and associated risks to improve such relations;
f) For commercial and strategic and operational marketing purposes.

2. Method of Processing

Data processing may include, in addition to collection, the recording, organization, structuring, storage, adaptation, modification, extraction, consultation, use, communication through transmission, dissemination or any other form of making available, comparison or interconnection, restriction, erasure or destruction. It will be carried out both using paper support and with the help of electronic, computerized and telematic tools, according to methods and with tools aimed at ensuring data security and confidentiality, in compliance with Articles 32 and following of Regulation (EU) 2016/679, concerning “personal data security”.

In particular, all adequate technical, computer, organizational, logistical and procedural security measures will be adopted according to the level of risk related to the nature of the data.

Furthermore, the methodologies applied ensure that access to data is allowed only to persons in charge of processing by our Company.

3. Data Provision

The provision of data is:

a) Mandatory for achieving purposes connected to obligations required by laws or other binding regulations;
b) Necessary for the correct establishment and continuation of the relationship with you.

Any refusal to provide the above data, although legitimate, could compromise the regular conduct of the relationship with our Company and, in particular, could make it impossible for us to execute your orders, as well as to perform the requested services and related billing.

4. Communication and Dissemination of Data

External communication of personal data collected for the purposes referred to in point 1 may only occur where:

a) Such communication is obligatory to ensure compliance with the obligations provided by law or other binding norms;
b) Such communication is obligatory to ensure the proper establishment or continuation of the business relationship with you.

The personal data collected for the purposes indicated above may be communicated, as far as their specific competence, to public and private entities, individuals and/or legal persons for commercial and/or management of information systems and/or payment systems, including external responsible parties and sub-responsible parties for processing who carry out specific assignments on behalf of our Company.

In particular, the data may be communicated to the following categories of subjects: commercial network, banking institutions and companies specialized in payment management, legal and consulting firms, subjects responsible for auditing our company’s balance sheet, public authorities or administrations for legal obligations, Italian and foreign suppliers, financing and transport companies, third parties responsible for quality control of the logistical-commercial flow, as well as to other companies in our Group. The data may also be disseminated, but only in aggregated, anonymous form and for statistical purposes according to law.

5. Data Transfer Abroad

Within the strict limits necessary for the execution of the contractual relationship with you, your personal data may be communicated to third parties (such as suppliers) located abroad, inside or outside the European Union, always in respect of the rules contained in Articles 44 to 50 of Regulation (EU) 2016/679.

Rights of the Data Subject
Under Articles 12 and 15 to 22 of Regulation (EU) 2016/679, you have the right to request, with the requirements and within the limits of said regulation, to:

  • Access personal data
  • Rectify inaccurate personal data
  • Erase personal data
  • Restrict the processing of personal data
  • Receive notification in the case of rectification, erasure, or restriction of personal data.
